Hermoso launches a lawsuit over Rubiales’ kiss

Hermoso files legal complaint over Rubiales kiss

Jenni Hermoso has filed a court complaint against Spanish Football Federation head Luis Rubiales over the kiss.

Rubiales kissed Hermoso on the lips during Spain’s World Cup victory, which she claims was not consented to.

Rubiales maintains the kiss was “mutual and “consensual,” but Fifa, football’s international governing body, has temporarily suspended him.

According to the lawsuit, the 46-year-old might face criminal penalties.

According to a statement from the national prosecutor’s office, “Jennifer Hermoso filed an express complaint for the facts that you are all aware of.”

“The national court’s prosecutor’s office will file a complaint as soon as possible. The statement took place at the state attorney general’s office to protect the privacy of the victim.”

On August 29, Spanish prosecutors launched a preliminary inquiry into whether the occurrence constituted a sexual assault offence.

Spain’s top criminal court said at the time that it would launch an inquiry in response to the “unequivocal nature” of 33-year-old Hermoso’s statements, saying it was necessary “to determine their legal significance”.

“Given the public statements made by Jennifer Hermoso, the sexual act she was subjected to by Luis Rubiales was not consensual,” a statement said.

It added that legal experts would also contact her “to offer her the option of legal action, giving her the chance to contact National Court prosecutors within 15 days for information about her rights as a victim of an alleged sexual assault should she wish to file a complaint”.

The statement added: “In order to proceed with a case for sexual assault, harassment or sexual abuse, it will be necessary for the injured party or their legal representative to file suit, or the public prosecutor’s office.”

Hermoso is said to have submitted her case on Tuesday.

Rubiales, who was spotted grasping his crotch before the kiss while celebrating Spain’s 1-0 triumph against England, has consistently refused to quit from his job.

Spain’s national sports tribunal (TAD) started a misconduct action against him on Friday, concluding that he had committed a “serious offence” by kissing Hermoso.

The TAD, however, went short of the “very serious offence” demanded by the government, which would have resulted in his suspension.

81 Spanish players, including all 23 World Cup winners, have stated that they would not play for Spain again while Rubiales is in charge.

They are scheduled to participate in Uefa Nations League qualification against Sweden and Switzerland on September 22 and 26.

On Tuesday, Spain’s World Cup-winning head coach Jorge Vilda, a close ally of Rubiales, was fired, and Montse Tome was selected as his replacement.

On Monday, the Spanish men’s team chastised Rubiales for his “unacceptable behaviour.”

However, Spain and Real Madrid defender Dani Carvajal was chastised for stating that he would not decide whether Hermoso was a victim or not until the judicial procedure was concluded.

In an interview with Spanish radio station Onda Cero on Tuesday, he said: “There are legal bodies that are considering whether Jennifer is really a victim of something that is being investigated.

“There are people who have to decide whether there is an offender and a victim.”

Carvajal attempted to justify his statements on Wednesday, saying that “Rubiales should be supported in the same way as Jenni Hermoso” throughout this process.

He added: “I can understand that Jenni is going through a bad time, we have to show my solidarity. However, I don’t think the president is having a good time either. I am not here to judge anyone.

“The presumption of innocence is a constitutional right. You cannot victimise or blame anyone.

Sergio Ramos, a former Spain defender, called Rubiales’ attitude “unacceptable.”

“As the president of the federation and a representative of Spanish soccer, I think he’s mistaken,” he said.

“I think instead of talking about the whole Rubiales issue which has taken over, we should instead – and I’ll take the opportunity now to once again congratulate the women’s squad who are world champions and this after we did it in 2010.

“But in 2023 what everyone should be talking about is that the women’s squad are world champions. So, I want to send my sincere congratulations. And I hope soccer has the representatives it deserves.”

After the game, Miami coach Gerardo Martino stated that both Alba and Messi would be assessed in the following days, but neither would be available to play against Orlando City on Sunday in order to be ready for the US Open Cup final against Houston Dynamo next Wednesday.

“There is no chance they will be there on Sunday. I know we have a final to play [next Wednesday] but they won’t go near the pitch if they can’t play,” said Martino.

Messi and Alba, who both began the game after missing Saturday’s 5-2 loss to Atlanta United FC, were not involved in any especially strong challenges or visibly hobbling but were plainly in pain.

“They trained normally and we felt like they were ready to play,” Martino said through an interpreter. “I don’t believe it’s anything new or anything worse than what they had before. It’s fatigue. We don’t think it’s a muscular injury. That’s also from a conversation that I just had with [Messi]. But we have to continue being careful and we’ll look at him the next few days.”

He added: “I’m cautious about what can happen and after talking to them, I’m less pessimistic than I was when I had to bring them off.”

Man City's treble winners have been nominated for FIFA men's honours

Six Manchester City players who helped them win the treble in 2022-23 are among the contenders for men’s player of the year at the 2023 Fifa Best Awards.

Half of the 12 players in contention for the trophy are Erling Haaland, Julian Alvarez, Kevin de Bruyne, Ilkay Gundogan, Rodri, and Bernardo Silva.

Lionel Messi and Kylian Mbappe, both two-time winners, are also competing for the coveted accolade, as is England’s Declan Rice.

Pep Guardiola, the manager of Manchester City, has been nominated for coach of the year.

He is up against three other managers, including Tottenham’s former Celtic manager Ange Postecoglou.

Argentina was the World Cup champion. Messi currently has the Player of the Year accolade.

Cristiano Ronaldo, who won the award in the first two years, is not nominated this year after joining Saudi Arabian club Al Nassr in December.

Rice, 24, is attempting to become the first English winner of the award.

Ederson of Manchester City and Andre Onana of Manchester United are both nominated for top custodian.

A team of football experts, including former Chelsea striker Didier Drogba, selected the nominations.

The voting period for the eighth annual awards began on Thursday on Fifa.com and will end in mid-October.

The voters include national team coaches, captains, journalists, and fans.
